Terms of use

The rules for playing Bublumy and for the optional Full game purchase.

1. Agreement

These terms are an agreement between you and Wanderpool, LLC, which operates under the DigyNow brand in the United States (“we”, “us”). By downloading, installing or playing Bublumy, you agree to them. If you don't agree, please don't use the game. The terms of the store you got Bublumy from (Google Play or the Apple App Store) also apply.

If you are under the age of majority where you live, a parent or guardian should review these terms with you and approve any purchase.

2. Your license to play

We give you a personal, non-exclusive, non-transferable, revocable license to install and play Bublumy on devices you own or control, for your own non-commercial entertainment, as allowed by the store's usage rules.

You may not copy, sell, rent, distribute or publicly host the game; modify it, or create or use cheats, hacks or tools that alter it or unlock paid content without paying; or reverse-engineer it, except where the law expressly allows.

Bublumy, the Bublumys, and the game's artwork, music, text and code belong to Wanderpool, LLC or its licensors and are protected by law. The license does not give you ownership of them. Open-source components, such as the Godot Engine and the Nunito typeface, remain under their own licenses.

3. Free play and the “Full game” purchase

Bublumy is free to download and start. Free play includes the Tutorial, the Easy and Medium modes for the whole first ocean (Tide 1, up to 560 m), the Daily Dive, and the pearl shop and wardrobe.

“Full game” is an optional, one-time, non-consumable in-app purchase (product ID bublumy_full_game). It unlocks Tide 2 onward (endless tides) in any mode, the Tide 2 checkpoint and the Hard and Expert modes, together with the content they include. The purchase gives you a license to use that content as described in these terms; it is not a sale of the content itself.

The price is set in, and shown by, Google Play or the App Store in your local currency, with any taxes they apply, before you confirm. The store charges you; we never receive your payment details. There are no subscriptions, no advertising, no loot boxes and no sale of in-game currency. Pearls are earned only by playing, have no monetary value and cannot be bought, sold, transferred or exchanged for money. We may change the price for future buyers; that does not affect a purchase you have already made.

4. Restoring your purchase

Your purchase is linked to the Google account or Apple ID you used to buy it. To unlock it again on a new or reset device, sign in to the store with the same account, open Bublumy and tap Settings → Restore (also available on the Full game screen). Restoring needs an internet connection. Step-by-step instructions are on the Help and support page.

5. Refunds

Because Google and Apple process the payment, refunds are handled by them under their own refund policies:

If a purchase is refunded, cancelled or reversed, the full game content is locked again the next time the game checks with the store. Your free progress is not affected. Nothing in these terms limits refund or other rights you have under consumer protection laws that cannot be waived.

6. Your progress

Your progress is stored only on your device. We do not run game servers or offer cloud saves, so we cannot recover, transfer or restore lost progress. Uninstalling the game or clearing its data deletes it. See the Privacy policy for details.

7. Availability and changes to the game

We work to keep Bublumy fun and working well, but we provide it “as is” and “as available”. We don't guarantee that it will be uninterrupted or error-free, that it will work on every device or operating-system version, or that it will be offered in every country or kept available in the stores. We may update, change or stop offering the game or parts of it. Buying and restoring depend on the stores' services being available.

8. Limitation of liability

To the fullest extent allowed by law, Wanderpool, LLC will not be liable for indirect, incidental, special or consequential damages, or for loss of data or progress, arising from your use of Bublumy, and our total liability for any claim relating to the game is limited to the amount you paid for the Full game purchase. Some places do not allow these limits, so they apply only as far as the law allows, and they do not affect rights that cannot legally be excluded.

9. Apple and Google

These terms are between you and Wanderpool, LLC, not Apple or Google. Apple and Google are not responsible for the game, its content, maintenance or support, or for any claims relating to it, except as stated in their own terms. If you downloaded Bublumy from the App Store, Apple's standard Licensed Application End User License Agreement also applies, and Apple and its subsidiaries are third-party beneficiaries of these terms.

10. Governing law

These terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-law rules. Any dispute will be handled by the competent courts located in Alabama, unless the law of the country where you live requires otherwise. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

11. Changes to these terms

We may update these terms, for example when the game or the law changes. We will publish the new version on this page with a new “Updated” date and, for important changes, let you know in the game or on this website when practical. If you keep playing after an update, the new terms apply.
